Colorado Appellate Court Overturned Developer’s 2009 Theft Conviction

Shawn Eric Gillum has a background as a television news reporter, and has also practiced law in Denver, Colorado. During his time as an attorney, Shawn Eric Gillum guided the Orr Law Firm, LLC’s legal research and writing department and represented clients in a number of local cases.

One such case reported by the Denver Post in 2012 involved the Colorado Court of Appeals overturning One Lincoln Park developer Erik Osborn’s felony theft conviction and ordering that a new trial be initiated. Osborn was convicted in 2009 of bilking real estate investors of $255,000, but the judges in the appeals court determined that the Denver District Court judge had made an error in excluding testimony from all of the defendant’s defense witnesses.
Following the 2009 conviction, Osborn received a sentence of 10 years of community corrections. This was followed by an additional 10-year sentence of community corrections in a separate 2010 case involving felony theft and a different downtown development.
Speaking with the Post, Mr. Gillum described the decision as good news for his client, and noted that it was not yet decided whether a plea bargain would occur, or if the case would be tried again.
